ARTICLE 1: GENERAL PROVISIONS

These Terms and Conditions ("Terms") govern your use of the Elements Casino Brantford (the "Casino" or "Facility"). By entering, playing games or participating in any promotions at the Facility, you agree to be bound by these Terms.

ARTICLE 2: AGE RESTRICTIONS AND RESPONSIBLE GAMBLING

You must be at least 19 years old to enter and participate in gaming activities at the Facility. The Casino reserves the right to verify your age and may refuse entry or participation if we have reason to believe you are under the required minimum age.

The Casino encourages responsible gaming practices and urges players to set deposit limits, take regular breaks and seek help if experiencing any problems with their gambling habits.

ARTICLE 3: GAMING RULES AND REGULATIONS

All games at the Facility are subject to the relevant laws and regulations of Ontario. The outcome of every game is determined solely by chance, and no one can influence or manipulate the results in any way.

The Casino reserves the right to change or modify its gaming rules, policies and procedures without prior notice. Players must familiarize themselves with these Terms and the specific rules for each game before participating.

ARTICLE 4: PLAYER RESPONSIBILITIES

You are responsible for maintaining your own account information, including your username, password and deposit limits, up-to-date. You agree to notify us of any changes to this information immediately.

By entering or playing games at the Facility, you confirm that:

• You have read, understood and will comply with these Terms;
• You will not use the services for any unlawful or unauthorized purpose;
• You will play responsibly and within your means; and
• You will report any irregularities, cheating or other suspicious activity to our staff immediately.

ARTICLE 5: DEPOSIT AND WITHDRAWAL LIMITS

You can set deposit limits on your account at any time. The Casino also reserves the right to impose temporary or permanent restrictions on a player's account if we reasonably believe that they are not able to control their gambling habits.

Withdrawal requests will be processed within a few business days of receiving the request, subject to verification requirements and other regulatory obligations.

ARTICLE 6: SECURITY MEASURES

We use industry-standard encryption technologies (such as TLS) to protect your data. However, you agree that we are not responsible for any unauthorized access or loss of personal information that may occur despite our efforts to safeguard it.

ARTICLE 7: PROMOTIONS AND SPECIAL OFFERS

All promotions and special offers at the Facility are subject to specific terms and conditions that will be disclosed before participation is allowed. By participating in these activities, you agree to abide by their rules and requirements.

The Casino reserves the right to change or cancel any promotion or offer without prior notice.

ARTICLE 8: ACCOUNT RESTRICTIONS

We reserve the right to restrict access to your account if we reasonably believe that:

• You have breached these Terms;
• Your gaming habits are problematic; or
• There is a risk of unauthorized access to your account

In such cases, you agree that we can take steps to prevent further participation and may terminate this Agreement at our discretion.

ARTICLE 9: APPLICABLE LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of Ontario. Any disputes or claims arising out of these Terms will be resolved exclusively through binding arbitration, with the location determined solely at our discretion.

ARTICLE 10: AMENDMENTS TO TERMS AND CONDITIONS

The Casino reserves the right to modify or update these Terms without prior notice. Your continued use of the Facility after such amendments take effect shall be deemed as your acceptance and agreement thereto.
